1. PURPOSE, PROMOTER AND CONTRACTUAL STRUCTURE
1.1 The Bitpanda Advent Calendar 2025 (or, the 'Promotion') is a multi-jurisdictional promotion. All Entries from all Participating Jurisdictions are treated equally and all Winners are selected fairly, transparently, and by chance alone.
1.2 Bitpanda is the promoter of the Promotion for Eligible UK Persons and these UK Master Terms govern the Promotion as between Bitpanda and persons physically in the UK and, in particular, supplement each such person's User Agreement, and incorporate, and are supplemented by, each set of UK Mini Terms.
1.3 By participating in the Promotion whilst you are physically in the UK:
you agree to be bound by these UK Master Terms and each applicable set of UK Mini Terms; and
you represent and warrant that you meet the eligibility requirements in these UK Master Terms and each applicable set of UK Mini Terms and acknowledge that failure to meet all such eligibility requirements may result in your Disqualification from all or part of the Promotion.
1.4 The User Agreement and all applicable Product Terms (including the E-Token Terms) continue to apply to your Account and your use of the Bitpanda Platform.
1.5 In the event of any inconsistency:
between these UK Master Terms and the User Agreement in relation to the Promotion, these UK Master Terms prevail solely to the extent of that inconsistency; and
between these UK Master Terms and the UK Mini Terms, the UK Mini Terms prevail for the relevant Daily Draw.
2. DEFINITIONS
2.1 In these UK Master Terms, capitalised terms have the meanings set out below.
2.2 In these UK Master Terms, unless the context otherwise requires:
"Account" has the meaning ascribed to that term in the User Agreement.
"ASA" means the Advertising Standards Authority in the UK (or any successor body).
"Bitpanda", "we", "us", or "our" means Bitpanda Broker UK Ltd, a company incorporated in England and Wales with registration number 11412485 whose registered office is at Atlantic House, Holborn Viaduct, London, EC1A 2FG, United Kingdom, and which is registered with the UK Financial Conduct Authority as a cryptoasset business under the Money Laundering, Terrorist Financing and Transfer of Funds (Information on the Payer) Regulations 2017 for the purposes of AML and CFT supervision only.
"Bitpanda GmbH" means Bitpanda GmbH, a company incorporated in Austria with registration number FN 569240 v whose registered office is at Stella-Klein-Löw-Weg 17, 1020 Vienna, Austria.
"Bitpanda Group" means Bitpanda GmbH and any entity that, directly or indirectly, controls, is controlled by, or is under common control with Bitpanda GmbH from time to time.
"Bitpanda Platform" has the meaning ascribed to that term in the User Agreement.
"CET" means Central European Time (being GMT+1 and UTC+1).
"Daily Challenge" means a specific challenge, task, quiz, or other action that a person must complete in order to obtain a Daily Entry and a Grand Prize Entry, as prescribed in the respective Local Mini Terms.
"Daily Challenge Period" means a calendar day within the Promotion Period on which a Daily Challenge may be completed and to which a Daily Draw is linked, as specified in the respective Local Mini Terms.
"Daily Draw" means each daily free prize draw forming part of the Promotion during the Promotion Period, in which a person who has successfully completed the relevant Daily Challenge is selected as a winner and becomes eligible to receive a prize, as contemplated in, and pursuant to, the Local Master Terms and the Local Mini Terms.
"Daily Entry" means an entry into a Daily Draw, determined to be valid pursuant to the respective Local Master Terms and Local Mini Terms by the respective Local Promoter, which is obtained by completing the relevant Daily Challenge in accordance with the respective Local Master Terms and Local Mini Terms and which is transmitted to the Global Administrator for inclusion in the Global Daily Prize Pool for that Daily Draw.
"Daily Prize" means any prize that is awarded under a Daily Draw, as defined in the Local Mini Terms.
"Daily Winner" means a Provisional Daily Winner that has been confirmed by the relevant Local Promoter as having satisfied all relevant eligibility requirements.
"Disqualification" means the determination by Bitpanda, exercisable in its sole discretion, that a person is not eligible, or no longer eligible, to participate in the Promotion or receive a Prize with the result that all of such person's Entries (including Winning Entries) are immediately invalidated and removed from the Global Pools, such person's status as Provisional Winner or Winner (if any) is withdrawn, and such person is treated as having never had the status of Provisional Winner or Winner.
"Disqualified" means the status of a person, including an Entrant, a Provisional Winner, or a Winner, following a Disqualification, whereby such person is excluded from participation in the Promotion, excluded from the Global Pools, and ineligible to win or claim a Prize.
"Draw" means, for each Daily Draw and for the Grand Prize Draw, the process by which Winning Entries are selected from the relevant Global Pool by the Global Administrator, including by random selection using the Randomiser Tool, or by such other method as may be detailed from time to time in the respective Local Mini Terms.
"Draw Date" means, for each Daily Draw and for the Grand Prize Draw, the date on which the respective Draw takes place.
"E-Tokens" has the meaning ascribed to that term in the E-Token Terms.
"E-Token Terms" has the meaning ascribed to that term in the User Agreement.
"Eligible UK Person", "you", or "your" has the meaning ascribed to that term in Clause 4.
"Entrant" means a person that is eligible to participate in the Promotion pursuant to the relevant Local Master Terms and who successfully completes at least one Daily Challenge in accordance with the respective Local Mini Terms.
"Entry" means a Daily Entry, and a Grand Prize Entry.
"Entry Method" means the specific actions required to participate in a Daily Challenge, as defined in the respective Local Mini Terms.
"Global Administrator" means Bitpanda GmbH, being the person responsible for the aggregation of Entries into the Global Pools, the operation of the Randomiser Tool, and the carrying out of Draws.
"Global Daily Prize Pool" means, for a given Daily Draw, the combined set of all valid Daily Entries from all Participating Jurisdictions.
"Global Draws" means the Daily Draws and the Grand Prize Draw.
"Global Grand Prize Pool" means the aggregated pool of all Grand Prize Entries across all Participating Jurisdictions for the entire Promotion Period.
"Global Pools" means the Global Daily Prize Pool and the Global Grand Prize Pool.
"Grand Prize" has the meaning ascribed to that term in Clause 10
"Grand Prize Draw" means the single free prize draw forming part of the Promotion following the end of the Promotion Period, in which a person who has successfully completed at least one Daily Challenge is randomly selected as a winner and becomes eligible to receive a prize, as contemplated in, and pursuant to, these UK Master Terms.
"Grand Prize Entry" means an entry into the Grand Prize Draw, determined to be valid pursuant to the respective Local Master Terms and Local Mini Terms by the respective Local Promoter, which is obtained by completing a Daily Challenge in accordance with the respective Local Master Terms and Local Mini Terms and which is transmitted to the Global Administrator for inclusion in the Global Grand Prize Pool for the Grand Prize Draw.
"Grand Prize Winner" means the Provisional Grand Prize Winner that has been confirmed by the Local Promoter as having satisfied all relevant requirements.
"Guest" means a person who attends an event comprising all or part of a Prize as the guest of a Winner.
"Ineligible Person" has the meaning ascribed to that term in Clause 4.
"Local Master Terms" means each set of terms governing the Promotion and which apply to persons in the respective Participating Jurisdiction.
"Local Mini Terms" means each set of terms governing a specific Daily Challenge, Daily Draw, and Daily Challenge Period and which apply to persons in the respective Participating Jurisdiction, and which are incorporated in, and supplement, the respective Local Master Terms.
"Local Promoter" means, in respect of a Participating Jurisdiction, the Bitpanda Group entity identified in the applicable Local Master Terms as the promoter and contracting counterparty offering the Promotion to persons in that Participating Jurisdiction which, in the case of the UK, is Bitpanda.
"Privacy Notice" means the privacy notice of Bitpanda Group available here.
"Prize" means a Daily Prize, and the Grand Prize.
"Product Terms" has the meaning ascribed to that term in the User Agreement.
"Promotion" means the Bitpanda Advent Calendar 2025 prize promotion operated across multiple Participating Jurisdictions by the Local Promoters, and administered by the Global Administrator, comprising the Daily Draws and the Grand Prize Draw.
"Promotion Period" means the period beginning on 1 December 2025 at 00:00 CET and ending on 24 December 2025 at 23:59 CET.
"Provisional Daily Winner" means the Entrant whose Daily Entry is selected as a Winning Entry in a Draw for the respective Daily Draw.
"Provisional Grand Prize Winner" means the Entrant whose Grand Prize Entry is selected as a Winning Entry in a Draw for the Grand Prize Draw.
"Provisional Winner" means a Provisional Daily Winner and a Provisional Grand Prize Winner.
"Randomiser Tool" means the random number generator, computer-based algorithm, or equivalent technical mechanism, for the purposes of selecting winning Entries from the relevant Global Pool on the basis of chance.
"Super Bowl LX" means the championship game of the National Football League (NFL) officially designated as 'Super Bowl LX', concluding the 2025 NFL season, currently scheduled to be held on 8 February 2026, at Levi's Stadium in Santa Clara, California, USA.
"UK Daily Winner" means a UK Provisional Daily Winner who has been confirmed by Bitpanda as having satisfied all respective eligibility requirements.
"UK Entrant" means an Entrant who is an Eligible UK Person.
"UK Grand Prize Winner" means a UK Provisional Grand Prize Winner who has been confirmed by Bitpanda as having satisfied all respective eligibility requirements.
"UK Master Terms" means these Bitpanda Advent Calendar 2025 UK Free Prize Draw Terms and Conditions, being the Local Master Terms applicable to persons in the UK.
"UK Mini Terms" means each set of Local Mini Terms applicable to persons in the UK.
"UK Provisional Daily Winner" means a Provisional Daily Winner that is a UK Entrant.
"UK Provisional Grand Prize Winner" means a Provisional Grand Prize Winner who is a UK Entrant.
"UK Provisional Winner" means a UK Provisional Daily Winner and a UK Provisional Grand Prize Winner.
"UK Winner" means a UK Daily Winner and a UK Grand Prize Winner.
"User Agreement" means the document entitled the User Agreement for the Provision of Services by Bitpanda, including all annexes and other documents referred to therein, issued by Bitpanda from time to time and available here.
"Winner" means each Daily Winner and the Grand Prize Winner.
"Winning Entry" means, in respect of a Global Draw, the Entry selected in the corresponding Draw.
references to legislation:
include any subordinate legislation (including regulations and orders) made under that legislation, whether before or after the date of these UK Master Terms; and
include a reference to such legislation as from time to time amended or re-enacted (whether before or after the date of the UK Master Terms) and, where such legislation has re-enacted or replaced any other legislation, such other legislation,
and references to re-enactment include by way of consolidation or re-writing (whether with or without modification);
references to law include reference to all applicable legislation and law in any part of the world, and include all applicable rules and regulations, codes of practice, codes of conduct, handbooks, policy statements or other guidance (whether or not having the force of law) issued from time to time by any relevant authority;
references to a "person" include a natural person, partnership, company, association, joint venture, consortium, organisation, foundation, trust, government or state (in each case whether or not having separate legal personality);
references to a "company" include any company, corporation or other body corporate, wherever and however incorporated or established;
the singular shall include the plural and vice versa and references to any gender or the neuter include a reference to the other gender and the neuter;
any reference to these UK Master Terms or to any other document is a reference to these UK Master Terms or that other document as amended, varied, supplemented, replaced, restated or novated at any time; and
any reference to something being "in writing" or "written" shall include a reference to that thing being produced by any legible and non-transitory substitute for writing (including in electronic form) or partly in one manner and partly in another.
2.3 Unless otherwise stated, all references to times in these UK Master Terms, including the Promotion Period and any Daily Challenge Period, are to the local time in Vienna, Austria (CET).
2.4 Any words following the terms including, include, in particular, for example or any similar expression shall be interpreted as illustrative and shall not limit the sense of the words preceding those terms.
2.5 The headings in these UK Master Terms are inserted for convenience only and shall not affect the construction of these UK Master Terms.
3.ROLES AND RESPONSIBILITIES
3.1 Bitpanda Group determines the overall structure of the Promotion, designates the Global Administrator, and appoints Local Promoters in each Participating Jurisdiction.
3.2 The Global Administrator:
receives Entry data from each Local Promoter and constructs the Global Pool for each Global Draw;
operates the Randomiser Tool to select Provisional Daily Winners and the Provisional Grand Prize Winner;
records the outcome of each Global Draw; and
provides Local Promoters with the information they need to verify Provisional Daily Winners, and the Provisional Grand Prize Winner, and to fulfil Daily Prizes and the Grand Prize.
3.3 Each Local Promoter is responsible, in its Participating Jurisdiction, for:
promoting the Promotion and communicating the applicable Local Master Terms and Local Mini Terms;
determining whether a person is eligible to be an Entrant and whether an Entry is valid, in accordance with the Local Master Terms and the Local Mini Terms;
operating and enforcing anti-abuse measures under the Local Master Terms and the Local Mini Terms;
verifying Provisional Daily Winners and the Provisional Grand Prize Winner; and
awarding and fulfilling Prizes to Winners in accordance with local Applicable Law, the Local Master Terms and the Local Mini Terms.
3.4 The Global Administrator provides services to Local Promoters only and does not enter into any contract with Entrants. Contractual rights and obligations with respect to the Promotion arise solely under the respective Local Master Terms and the Local Mini Terms.
4. ELIGIBILITY (UK)
4.1 In the UK, the Promotion is open to persons who, at the time of completing the relevant Daily Challenge:
are at least eighteen years of age;
are physically present in the UK;
are ordinarily resident in the UK;
hold a valid, fully verified Account pursuant to the User Agreement;
are not in material breach of the User Agreement or any other agreement with any Bitpanda Group entity; and
are not Ineligible Persons,
(each, an "Eligible UK Person").
4.2 The following persons are not eligible to participate in the Promotion in the UK:
any employee, director or officer of any Bitpanda Group entity, and members of their immediate families and households;
any affiliated person, promotional partner, or advertising agency of any Bitpanda Group entity, or an employee, director or officer of any such entity, or a member of the immediate family or household of any of them;
any person that performs market making (or similar) services;
any person that uses Bitpanda Technology Services (BTS);
any person that is an institutional investor;
any person who is professionally connected with the administration of the Promotion in any capacity;
any person subject to sanctions, anti-money laundering restrictions, or other legal restrictions that would prohibit the award of a Prize;
any person whose Account is suspended, blocked or closed; and
any other category of person described in the relevant UK Mini Terms as being ineligible,
(each, an "Ineligible Person").
4.3 Each Eligible UK Person may participate in the Promotion only through a single Account. Multiple Accounts controlled by the same Eligible UK Person are prohibited, and Bitpanda may Disqualify any person whose Entries it believes in its sole discretion originate from duplicate, fictitious, or fraudulent Accounts.
4.4 Bitpanda may request such documentation as it reasonably requires to verify eligibility, including proof of age and proof of UK residency. Failure to provide suitable evidence within a reasonable period may result in Disqualification.
5. ENTRY MECHANICS
5.1 For each Daily Challenge Period, the applicable UK Mini Terms will specify, amongst other things:
the start time of the Daily Challenge Period and the end time of the Daily Challenge Period;
the applicable Daily Challenge and its conditions; and
the Daily Prize available.
5.2 Subject to the UK Mini Terms, an Eligible UK Person who successfully completes the Daily Challenge during the Daily Challenge Period for a given Daily Challenge Period will receive:
one Daily Entry in the Daily Draw for that Daily Challenge Period; and
one Grand Prize Entry in the Grand Prize Draw.
5.3 Each Eligible UK Person may receive no more than:
one Daily Entry per Daily Challenge Period;
one Grand Prize Entry per Daily Challenge Period; and
twenty-four Grand Prize Entries in aggregate during the Promotion Period.
5.4 Daily Entries do not roll over between Daily Challenge Periods. Grand Prize Entries accumulate over the Promotion Period and are used only in the Grand Prize Draw.
5.5 Entries are not transferable or assignable and may not be sold, traded or otherwise dealt with. No third party may enter on behalf of an Eligible UK Person.
5.6 Daily Challenges are typically knowledge-based or educational, and no purchase is necessary for an Eligible UK Person to obtain an Entry.
6. GLOBAL POOL AND GLOBAL DRAWS
6.1 For each Daily Challenge Period and for the Promotion Period:
each Local Promoter compiles a list of all valid Entries for eligible Entrants in its Participating Jurisdiction;
the Local Promoter transmits to the Global Administrator, in pseudonymised form, the Entry data required for the Global Administrator to construct the Global Pool (for example, unique participant IDs and Entry counts); and
the Global Administrator consolidates the data from all Participating Jurisdictions to create the Global Pool for the relevant Draw and conducts the Draw.
6.2 Each valid Daily Entry in the Global Pool for a Daily Draw, and each valid Grand Prize Entry in the Global Pool for the Grand Prize Draw, has an equal chance of being selected as a Winning Entry. No Entrant has a greater likelihood of winning than any other Entrant solely because of their respective Participating Jurisdiction, Account size, investment behaviour, or any factor other than the number of valid Entries that the Entrant has earned.
6.3 For each Daily Challenge Period:
after the end of the respective Daily Challenge Period in all Participating Jurisdictions, the Global Administrator conducts one or more Draws to select one or more Daily Entries from the Global Pool for that Daily Challenge Period;
each Entrant associated with each Winning Entry is recorded as a Provisional Daily Winner;
the Global Administrator informs the relevant Local Promoter; and
the Local Promoter verifies that each Provisional Daily Winner satisfies the applicable Local Master Terms and the Local Mini Terms and has complied with Applicable Law.
6.4 After the end of the Promotion Period:
the Global Administrator conducts a Draw to select a Grand Prize Entry from the Global Pool for the Promotion;
the Entrant associated with that Winning Entry is recorded as the Provisional Grand Prize Winner;
the Global Administrator informs the relevant Local Promoter; and
the Local Promoter verifies that the Provisional Grand Prize Winner satisfies the applicable Local Master Terms and the Local Mini Terms and has complied with Applicable Law.
6.5 If a Local Promoter considers in its sole discretion that a Winner:
is not eligible;
has breached applicable Local Master Terms, the Local Mini Terms, or the User Agreement;
has failed to respond or complete any required steps of the Daily Challenge within the specified time; or
cannot lawfully receive or accept the Prize,
the Local Promoter will notify the Global Administrator and the Global Administrator will then conduct another Draw to select an alternative Entry from the same Global Pool (excluding Entries from persons who are Disqualified). This process may be repeated until an eligible Winner is ultimately confirmed.
6.6 For Eligible UK Persons, the Global Draws are free prize draws. Winning depends solely on chance. Knowledge, skill, or investment performance do not affect the outcome, although the probability of an Entrant being selected in a Draw scales linearly with the number of valid Entries held by that Entrant.
7. THE RANDOMISER TOOL
7.1 Whenever a Winner or Winners are to be selected at random, the Randomiser Tool will be used to ensure that each valid Entry in a Global Pool has an equal chance of being selected in the respective Draw.
7.2 The Global Administrator may use a third-party service or an internally developed tool for the Randomiser Tool. In each case, the Global Administrator will implement controls to mitigate the risk of bias or manipulation.
7.3 The Global Administrator will maintain documentation sufficient to demonstrate the fair operation of the Randomiser Tool and the Global Draws.
8. RECORDS AND TRANSPARENCY
8.1 The Global Administrator will maintain records of:
the data received from each Local Promoter for each Global Pool (in pseudonymised form);
the date and time of each Global Draw;
the Randomiser Tool outputs identifying the Provisional Daily Winners and the Provisional Grand Prize Winner; and
communications with Local Promoters in relation to the verification of Winners and any re-Draws.
8.2 Each Local Promoter will maintain records of its own entries, eligibility checks, and winner verification processes, and will provide those records to the Global Administrator on request.
8.3 Where required by Applicable Law or by any competent authority or self-regulatory body (including, in the UK, the ASA), Bitpanda Group and the relevant Local Promoter will provide reasonable evidence that the relevant Global Draw and/or Draw has been conducted fairly and in accordance with the applicable Local Master Terms and the Local Mini Terms.
9. PRIZES GENERAL
9.1 The Grand Prize is described in these UK Master Terms, and the Daily Prizes are described in the respective set of UK Mini Terms.
9.2 Bitpanda may substitute a Prize (or any component of a Prize) with an alternative where necessary.
9.3 No cash alternative is available to any Prize except in the situation where Bitpanda determines, in its sole discretion, that a cash alternative to the Prize is necessary due to legal, regulatory or operational constraints.
9.4 Prizes are personal to the Winner and may not be sold or transferred, save as expressly permitted in these UK Master Terms or the UK Mini Terms (for example, where the Winner is permitted to allocate a ticket, comprising part of a Prize, to a Guest).
9.5 Prizes may be subject to additional terms and conditions imposed by third-party providers (for example, airlines, hotels, event organisers, or merchandise suppliers) and, by accepting a Prize, Winners agree to comply with all such terms and conditions and agree to procure that their Guest complies with all such terms and conditions.
9.6 Bitpanda will not be responsible for, and will not replace, any tickets, travel documents, or other elements of a Prize that are lost, stolen, destroyed, damaged, or otherwise not used for any reason, except where required by Applicable Law.
9.7 Winners are solely responsible for any tax, social security, or similar obligations that arise in connection with their participation in the Promotion or their receipt, holding, or disposal of any Prize. Bitpanda does not provide tax advice and will not be liable for any failure by a Winner to report or pay any applicable taxes.
10. THE GRAND PRIZE - A TRIP TO SUPER BOWL LX
10.1 Subject to these UK Master Terms, where the Grand Prize Winner is a UK Grand Prize Winner, the UK Grand Prize Winner will be entitled to a trip for two persons (being the UK Grand Prize Winner and a single Guest) to Santa Clara, California, USA, to attend Super Bowl LX (the "Grand Prize").
10.2 The Grand Prize comprises:
two tickets to Super Bowl LX (in a ticket category determined by Bitpanda) to be used by the UK Grand Prize Winner and the Guest;
return economy-class flights for the UK Grand Prize Winner and the Guest from a major UK airport (to be selected and arranged by Bitpanda) to California, USA; and
hotel accommodation in or near Santa Clara, California (to be selected and arranged by Bitpanda) for three nights, in a single, standard double or twin room, on a room-only basis, to be shared by the UK Grand Prize Winner and the Guest,
and, in any case, shall not exceed an aggregate cost or value (whichever is the higher) of EUR 30,000.
10.3 The Grand Prize expressly excludes, and the UK Grand Prize Winner and Guest are solely responsible for:
visa fees, passport costs, travel insurance and any medical or vaccination requirements;
travel to and from the departure airport in the UK;
local transfers, food, drinks and other incidentals not expressly included; and
compliance with all Applicable Laws and third-party venue and service providers' terms and conditions.
10.4 If the UK Grand Prize Winner or Guest:
fails to obtain necessary visas or travel permissions;
fails to comply with health or safety requirements; or
is otherwise denied boarding, entry into the destination country or entry to the event,
no alternative prize or compensation will be provided.
10.5 If Super Bowl LX or material components of the Grand Prize are cancelled, postponed, or materially altered, Bitpanda may, in its sole discretion, provide an alternative prize, but is under no obligation to do so.
10.6 The Promotion is not sponsored, endorsed, or administered by, or associated with, the National Football League (NFL), its member clubs, or any of their affiliates and such persons take no responsibility for the organisation or conduct of the Promotion. By accepting the Grand Prize, the UK Grand Prize Winner agrees to comply, and agrees to procure that their Guest complies, with all ticketing and venue terms and conditions imposed by the National Football League (NFL), its member clubs, or any of their affiliates or service providers. This prize draw is not in any way sponsored, endorsed or administered by, or associated with The Arsenal Football Club Limited. By entering the prize draw, you acknowledge that Arsenal shall not have any liability to you in connection with this prize draw.
10.7 Any changes requested by the UK Grand Prize Winner or the Guest to travel or accommodation arrangements after they have been booked, and any associated costs or charges, are the sole responsibility of the UK Grand Prize Winner.
11. DAILY PRIZES
11.1 The Daily Prize for each Daily Challenge Period will be set out in the applicable UK Mini Terms.
11.2 Where a Daily Prize comprises or includes E-Tokens, the E-Token Terms and any applicable Product Terms apply in addition to these UK Master Terms and the relevant UK Mini Terms.
11.3 Daily Prizes may be subject to time limits for redemption or use, as specified in the UK Mini Terms or the relevant Product Terms.
12. WINNER NOTIFICATION AND CLAIMING PRIZES
12.1 Bitpanda will notify any UK Winner by email to the email address registered on that Winner's Account, within 14 days of the relevant Draw Date.
12.2 UK Winners must respond to the notification within 48 hours, confirming acceptance of the Prize and providing any information reasonably required for verification and fulfilment. Failure to respond within this period may result in Disqualification and selection of an alternative Winner.
12.3 Bitpanda will make reasonable efforts to contact UK Winners but is not responsible for:
failed, delayed or misdirected communications; or
any consequences of a UK Winner failing to update their contact details on their Account.
12.4 In order to demonstrate that a Draw has taken place, a Prize has been validly awarded, and to comply with Applicable Law, including the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing, Bitpanda may, subject to applicable data protection law:
publish or make available the surname and county of each UK Winner; and
provide such information to the ASA upon request.
12.5 UK Winners who object to the publication of their surname and county may notify Bitpanda of such objection. In such circumstances, Bitpanda will not publish this information publicly but may still share it with the ASA or other competent authorities upon request.
13. LIABILITY, SAFETY, AND CONDUCT
13.1 Nothing in these UK Master Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot lawfully be limited or excluded.
13.2 Subject to the preceding paragraph, Bitpanda is not liable for:
Entries that are lost, delayed, corrupted, or not received for any reason;
any failure of the Bitpanda Platform, or of any device, network, or system;
any inability of a Winner or Guest to make use of any Prize, including any loss of travel or accommodation costs; or
participation by any Winner or Guest in any live event, travel, or experience forming part of a Prize, which is undertaken strictly at their own risk.
14. PERSONAL DATA
14.1 Bitpanda will process personal data for the purposes of:
administering the Promotion and operating the Global Pools;
verifying eligibility and identity;
awarding, arranging, and fulfilling Prizes;
complying with Applicable Law; and
demonstrating that a valid Draw and/or a valid award of a Prize took place, including publication of certain personal details of a UK Winner.
14.2 Bitpanda may share personal data with:
other Bitpanda Group entities, including the Global Administrator;
third-party providers involved in Prize fulfilment (including airlines, hotels, and ticketing providers); and
regulators, law enforcement agencies, and the ASA.
14.3 Personal data may be transferred outside the UK to countries that may not provide the same level of protection as UK law. Where this occurs, Bitpanda will ensure appropriate safeguards are in place in accordance with Applicable Law.

15. GENERAL
15.1 If Bitpanda has any reason to believe that there has been a breach of these UK Master Terms or the UK Mini Terms by a person, Bitpanda may, at its sole discretion, exclude that person from participating in all or part of the Promotion and/or Disqualify that person.
15.2 The decision of Bitpanda regarding any aspect of the Promotion is final and binding and no correspondence will be entered into about it.
15.3 Bitpanda may amend, suspend, or withdraw the Promotion in the UK in whole or in part, including to address fraud, abuse, or error, or to comply with Applicable Law or guidance.
15.4 If any provision of these UK Master Terms is found invalid or unenforceable, it shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force.
16. GOVERNING LAW AND JURISDICTION
16.1 These UK Master Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these UK Master Terms or their subject matter or formation shall be governed by and construed in accordance with the law of England and Wales.
16.2 The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these UK Master Terms or their subject matter or formation.
