Terms and Conditions
“Bitpanda Stan Wawrinka raffle”

1. General 

The following terms and conditions (“Terms”) govern the rules for participating in the Bitpanda Stan Wawrinka raffle (“Raffle”) of the Bitpanda GmbH, with its corporate seat in Stella-Klein-Löw-Weg 17 A-1020 Vienna, (“Bitpanda”) and the resulting legal relationship between Bitpanda and the Participant (as defined in Section 3 or “you”). 

Please be advised, participating in the Raffle shall constitute your unconditional acceptance to be bound by any and all of the terms of these Terms. Bitpanda Group TC and  Bitpanda GmbH & BAM TC in their current versions apply. 

The English version is a faithful translation of the original German version of these Terms. In the event of any discrepancy, the German version shall prevail.

Investing in digital assets carries risks. In extreme cases, the invested amount may be lost completely. Conduct your own research before concluding a transaction. Section 24 of the Bitpanda Group Terms apply. This Raffle does not constitute financial advice or an invitation to conclude a transaction. You should keep yourself informed and understand the risks involved in buying and holding digital assets. 

2. Duration 

This Raffle will begin on the 16th of July 2024, at 00:00 (CET) and ends on 30th of July 2024, at 23:59 (CET). Bitpanda reserves the right to change or end the Raffle at any time (“Raffle Period”).

3. Eligibility and Entry: 

Entry is open to new Bitpanda Clients (“Participants”) who (a) create a Bitpanda account within the competition period via the link provided, successfully complete the registration and verification process and thus become a new Bitpanda Client (Note: Bitpanda only allows one Bitpanda account per Bitpanda Client. Duplicate customer accounts are prohibited),

(b) fulfil all the requirements set out in these terms and conditions and accept the conditions of participation,

(c) are not resident in a country where the Raffle is not available*.

The following natural or legal persons are excluded from participation in the Raffle:

1. Persons who provide market-making services or similar services as well as all institutional customers
2. Bitpanda Technology Solution customers
3. Employees and the immediate family members of such employees of Bitpanda or its affiliated companies, parent companies, subsidiaries, participating promotional partners, advertising agencies, and any company involved in the creation, production, or fulfilment of the Raffle are also not eligible.

*Please note that - due to regulatory requirements - the Raffle is not available for users in certain jurisdictions (such as residents of Turkey, the Netherlands, Belgium and the United Kingdom). This notice is not intended for users/countries where restrictions apply.

By participating in the Raffle, you confirm that you fulfil the following conditions of participation and accept that failure to fulfil all conditions of participation will result in disqualification. 

4. Prizes, Winner Selection and Notification

After the end of the raffle period, Bitpanda will randomly select 1 participant ("Winner") who will receive one (1) signed Stan Wawrinka Outfit, Shorts and Shirt ("Prize"). Drawing will take place after the raffle has ended, but no later than one month after the end of the raffle period.

Only (new) Bitpanda Clients who (i) meet all the requirements described in section 3 and (ii) were not, for whatever reason, disqualified by Bitpanda in accordance with section 5 are eligible to be selected as the Winner.

Participants who are declared winners in accordance with this section will be notified by email to the email address registered in their Bitpanda account. The prize will be delivered to the Winner at the address provided. If a potential winner cannot be contacted, does not respond or refuses the prize, the potential winner will be disqualified without further notice and another winner may be selected. Bitpanda accepts no responsibility for undeliverable emails or packages. All potential winners are subject to verification by Bitpanda.

The awarded outfit cannot be redeemed for cash. There will be no replacement for lost, stolen, destroyed or damaged outfit.

5. Disqualification

Bitpanda reserves the right to disqualify a Participant it suspects or finds (i) to have tampered with the entry process or the operation of the Raffle, (ii) to be acting in collusion with other Participants aimed at manipulating or disrupting the Raffle, (iii) to be acting in violation of these Terms, (iv) or in breach of any other applicable terms and conditions of Bitpanda, its subsidiaries, or (v) to have provided inaccurate information.

Disqualified Participants will not be entitled to become the Winner or win any other Prize under this Raffle.

Any attempt by a Participant to deliberately undermine the legitimate operation of this Raffle is a violation of laws, and should such an attempt be made, Bitpanda reserves the right to seek damages from any such Bitpanda Client or individual. 

Bitpanda is not responsible for the accuracy of the data you provide and may disqualify a participant if the email address of the Bitpanda Client is not valid.

6. Limitation of Liability

To the extent permitted by law, in no event shall Bitpanda be liable for any direct or indirect loss arising out of or in connection with the Raffle. 

Bitpanda reserves the right to suspend, cancel, postpone or modify the Raffle if it cannot be executed as planned for any reason. You do not have any legal claim against Bitpanda arising out of or in connection with this Raffle.

7. Privacy and Taxes

All data processing at Bitpanda is carried out in accordance with Article 6 Paragraph 1 Letter b of the General Data Protection Regulation 2016/679 (“GDPR”) for the purpose of establishing the legal relationship with the participant and for the subsequent implementation and processing of the Raffle.

Participants are solely responsible for any/all applicable taxes related to the Prize. The potential Winner should consult a tax advisor to determine tax implications in accepting any Prize.
