The following Terms (“Terms”) govern the rules for participating in the Spain Deposit Fee Refund Promotion (“Promotion”) of the Bitpanda GmbH, with its corporate seat in Campus 2, Jakov-Lind-Straße 2, A-1020 Vienna (“Bitpanda”) and the legal relationship between Bitpanda and the Participant (as defined in section 3 or “you”) arising thereof.
By participating in the Promotion you confirm and accept these Terms and the applicable terms and conditions of Bitpanda which are an integral part of these Terms. Please note that the English version shall be the prevailing version.
2. Promotion period, Refund and fees
This Promotion begins on the 10th of September, 2021, at 12:00 am CET and ends on the 10th of October, 2021 at 12:00 am CET at the latest (“Promotion Period”).
During the Promotion Period, the standard fees for deposits will apply. You acknowledge that the end of the Promotion Period is flexible and may be terminated earlier at Bitpanda’s sole discretion.
Bitpanda will reimburse all Participants (as described in section 3) for all fees incurred by making a card deposit on Bitpanda within the Promotion Period. The refund shall be the amount incurred for the deposit fees worth in Bitpanda Ecosystem Token (BEST) (“Refund”).
You acknowledge and accept that only Participants who (i) meet all the requirements described in section 3 and (ii) were not, for whatever reason, disqualified by Bitpanda in accordance with section 5 are eligible for the Refund.
3. Requirements for Participation
Only fully verified and registered Bitpanda users ("Bitpanda Clients") that accept these Terms and have their country of residence in Spain are allowed to sign up and participate in the Promotion, as long as said client is not any natural or legal person performing market making services or similar services (“Participant”).
Further, in order to take part in the Promotion, Participants must have made:
(a) at least one fiat deposit using Mastercard, Visa credit or debit card.
(b) at least conducted one trade on the Bitpanda Broker within the Competition Period.
You are aware and accept that Bitpanda, at its sole discretion, may amend and/or call off the Promotion as described herein at any time and you do not have any legal claim against Bitpanda arising out of or in connection with this Promotion.
4. Refund and Notification
The Refund will be credited directly to the Participant’s respective Bitpanda BEST wallet.
Bitpanda will strive to transfer the Refund within 14 days after the end of the Promotion Period. The value of BEST is determined by the daily market value of the BEST/EUR trading pair in these 14 days. You acknowledge and agree that said transfer may be delayed and Bitpanda shall not be liable for any losses arising out of or in connection with a late transfer (e.g. losses due price changes).
You hereby acknowledge and accept that Bitpanda may disqualify a Participant from the Promotion at any time for whatever reason at its sole discretion, including but not limited to cases where Bitpanda suspects collusion between the Participants aimed at manipulating the Promotion or any other action by the Participants deemed unfair by Bitpanda.
You hereby acknowledge and accept that any breach of these Terms or any other terms and conditions of Bitpanda and/or its subsidiaries may result in disqualification.
If disqualified, you hereby acknowledge and accept that you will not have any claim against Bitpanda including but not limited to any direct or indirect losses you might have accumulated in connection with the participation in the Promotion.
6. Data protection
Bitpanda collects your personal data on the basis of your consent in accordance with article 6 section 1 letter a General Data Protection Regulation 2016/679 (“GDPR”) and insofar as this is necessary for the establishment of the legal relationship with the Participant and for the subsequent implementation and handling of the Promotion.
