Terms & Conditions for
“Giveaways“ via INSTAGRAM

1. General

The following terms and conditions (“Terms”) govern the rules for participating in the Ticket Giveaway (“Giveaway”) held by Bitpanda GmbH, with its corporate seat in Stella-Klein-Löw Weg 17, A-1020 Vienna (“Bitpanda”) and the resulting legal relationship between Bitpanda and participating Instagram users (“Participant” as defined in clause 3 or “you”).

The English version is a referential translation of the original German version of these Terms.  In the case of any discrepancy, the German version shall prevail. 

Please be advised, participating in the Giveaway shall constitute your unconditional acceptance to be bound by these Terms. 

2. Duration

This Giveaway begins on 16th of January, 2024, at the time of publication of the respective Instagram post and ends on 17th of January, 2024, at 23:59  (CET) (“Giveaway Period”).

3. Eligibility and Entry

Entry is open to Instagram users (“Participant”) who 

(a) meet all the requirements described in the respective Instagram post:

• Like the respective post.
• Follow our account @bitpanda.
• Comment the person you want to take with you to the game. 

(b) have reached the minimum participation age of 18 years,

(c) accept these Terms.

Each person may only take part in the Giveaway via Instagram once. Multiple entries are not permitted. Bitpanda reserves the right to exclude Participants from the Giveaway in the event of multiple entries.

Employees and the immediate family members of such employees of Bitpanda or its affiliated companies, parent companies, subsidiaries, participating promotional partners, advertising agencies, and any company involved in the creation, production, or fulfilment of the Promotion are also not eligible.

4. Prize Drawings, Notifying winners and Distribution of the Prize

After the Giveaway Period has ended, Bitpanda will according to the criteria set out below:

• randomly choose 1 Participant (“Winner”) that will receive 2 tickets to the Bundesliga Game FC Bayern München (“FCB”) vs. SV Werder Bremen on 21st of January 2024 (“Prize”). 

Only participating Instagram users who (i) meet all the requirements described in section 3 and (ii) were not, for whatever reason, disqualified by Bitpanda in accordance with section 5 are eligible to be selected as Winners.

Participants, who are declared Winners in accordance with this section will be notified via the comment-section under the respective Instagram-post. The winners must respond to this within 24 hours by providing Bitpanda with their contact details for further communication via private Instagram message. The Winners will be notified about the Prize and instructions on ticket delivery within 1 day after the draw. The Prize will then be distributed by Bitpanda via the FCB Ticketing Center; Winner will receive an email with further instructions to access the ticket via FCB Ticketing Center. In the event a potential Winner cannot be contacted, fails to respond or refuses the Prize, the potential Winner will be disqualified without further notice and an alternative Winner may be selected. Bitpanda assumes no responsibility for undeliverable emails. If any tickets have not been received 24 hours before the relevant event, the Winner shall contact Bitpanda. Potential winners may be subject to verification by Bitpanda.

The awarded tickets cannot be redeemed for cash or resold. There will be no replacement for tickets that are lost, stolen, destroyed or damaged.

5. Disqualification 

Bitpanda may disqualify a Participant it suspects or finds (i) to have tampered with the entry process or the operation of the Giveaway,  (ii) to be acting in collusion with other Participants aimed at manipulating the Giveaway, (iii) to be acting in violation of these Terms, (iv) to have provided inaccurate information.

Disqualified Participants will not be entitled to become a Winner or win any other Prize under this Giveaway.

6. Limitation of Liability

To the extent permitted by law, in no event shall Bitpanda be liable for any direct or indirect loss arising out of or in connection with the Giveaway. 

As the organiser, FCB may impose its own additional conditions for the receipt and redemption of the Prize, for which Bitpanda assumes no responsibility or liability.

Bitpanda reserves the right, without any prior notice or compensation to you, to suspend, cancel, postpone or modify the Giveaway, at any time, for any reason whatsoever. You do not have any legal claim against Bitpanda arising out of or in connection with this Giveaway.

7. Privacy and Taxes

The processing of personal data is carried out in accordance with Article 6 Paragraph 1 Letter b of the General Data Protection Regulation 2016/679 (“GDPR”) for the purpose of establishing the legal relationship with the participant and for the subsequent implementation and processing of the Giveaway.

Winners are solely responsible for any/all applicable taxes related to the Prize. Potential Winner should consult a tax advisor to determine tax implications in accepting any Prize.

8.Miscellaneous & Contact

Bitpanda reserves the right to amend the conditions of participation at any time. Should individual provisions of these conditions of participation be or become invalid, this shall not affect the validity of the remaining provisions of these conditions of participation. Cash payment of the prize is not possible. Legal recourse is excluded.

The Giveaway is in no way connected to Instagram and is in no way sponsored, supported or organised by Instagram. The recipient of the information provided by the participants is not Instagram, but Bitpanda as the organiser.
