1. General
The following Terms (“Terms”) govern the rules for participating in the Bitpanda Stocks Raffle & Giveaway (“Raffle & Giveaway”) of Bitpanda GmbH, with its registered office in Campus 2, Jakov-Lind-Straße 2, A-1020 Vienna (“Bitpanda”) and the legal relationship between Bitpanda and clients of Bitpanda who have (a) fully verified their account, (b) successfully completed a fiat money deposit of at least EUR/CHF/GBP 25 since the opening of their respective account and (c) accepted these Terms and the latest terms & conditions of Bitpanda dated April, 2021, whereby only the requirements of point (c) have to be fulfilled within the Giveaway Period (“Participant” or “you”).
By participating in the Raffle & Giveaway you confirm and accept these Terms and the applicable terms and conditions of Bitpanda which are an integral part of these Terms. You are aware and accept that Bitpanda may amend the Terms and/or call off the Raffle & Giveaway as described herein at its sole discretion at any time and you do not have any legal claim against Bitpanda arising out of or in connection with this Raffle & Giveaway.
Bitpanda informs you that only Participants who have their primary country of residence in one of the following countries can invest in Bitpanda Stocks & ETFs and are allowed to participate in the Raffle & Giveaway and to win the Raffle Prize, respectively referred to as the Giveaway Prize:
2. Raffle period and prize
The Raffle starts on 09.03.2021, 00:00 am (CEST) and ends on 13.05.2021, 11:59 pm (CEST) (“Raffle Period”).
Bitpanda will randomly select one person out of all Participants regarding the Raffle Prize after the end of the Raffle Period (“Raffle Winner”).
Each Participant can increase their chances to be the Raffle Winner by referring additional clients to Bitpanda. A referred client is defined as a person who registers on the Bitpanda platform by using the “Tell-a-Friend Programme” referral link, fully verifies their account and completes a fiat money deposit of at least EUR/CHF/GBP 25, whereby the completion of this process must fall within the Raffle Period. For every referral the name of the referrer is added to the list of potential Raffle Winners, whereby multiple referrals lead to multiple listings. For example, if a Participant refers three additional persons (who fulfill the above mentioned requirements of a referred client) their name will be included in the list of potential Raffle Winners a total of four times.
Each Participant can refer as many people from any country where registration on the Bitpanda platform and the respective full verification is possible. Please note that a referral of new Bitpanda clients who have their primary residence in one of the following countries is not possible:
The Raffle Winner will be randomly selected within 7 working days after the end of the Raffle Period. Bitpanda will aim to notify the Raffle Winner within 14 working days after the end of the Raffle Period. You acknowledge and agree that said notification may be delayed. The prize for the Raffle Winner is a new Tesla Model 3 Performance (“Raffle Prize”).
Bitpanda will contact the Raffle Winner via e-mail and/or phone. Bitpanda will organise the purchase and delivery process of the Raffle Prize and discuss the process with the Raffle Winner. Bitpanda will make sure to order the Raffle Prize within 6 months after the Raffle Winner has accepted the Raffle Prize via email, whereby after ordering the Raffle Prize Bitpanda cannot guarantee specific delivery times by Tesla and cannot be held liable therefore. In the event that the winner does not accept the Raffle Prize within 4 weeks of notification by Bitpanda, the Raffle Prize will be forfeited and Bitpanda will draw another eligible Bitpanda client as the new Raffle Winner, whereby this process is repeated until an eligible Raffle Winner accepts the Raffle Prize.
In the event that the Raffle Prize should feature Bitpanda branding (logo, special colour, lettering, etc.), said Bitpanda branding in its respective form may not be removed or altered by the Raffle Winner for 5 years from the date they take over the Raffle Prize, whereby Bitpanda has the right to check this at any time once a year (after reasonable notice - at least 2 weeks in advance).
You acknowledge and accept that only Raffle Participants who were not, for whatever reason, disqualified by Bitpanda in accordance with Section 4 are eligible to be selected as Raffle Winner.
3. Giveaway period and prizes
The Giveaway starts on the day of the official launch of Bitpanda Stocks & ETFs in April 2021, 09:00 am (CEST) and ends on 13.05.2021, 11:59 pm (CEST) (“Giveaway Period”).
Bitpanda will start to pay out a prize to all Participants with the start of the Giveaway Period (“Giveaway Winner”) whereby each prize consists of a randomly selected asset of Bitpanda’s new assets class: Bitpanda Stocks & ETFs (“Giveaway Prize”). The value of the randomly selected asset will be between EUR 5 and EUR 200.
The Giveaway Prize is paid out and automatically transferred to the respective asset wallet of the Bitpanda client within 14 working days after the end of the Giveaway Period at the latest. The Bitpanda client does not have to claim the Giveaway Prize in a separate process.
You acknowledge and accept that only Participants who were not, for whatever reason, disqualified by Bitpanda in accordance with Section 4 will be eligible to receive a Giveaway Prize.
4. Disqualification
You hereby acknowledge and accept that Bitpanda may, at its sole discretion, disqualify a Participant from the Raffle & Giveaway at any time for whatever reason, including but not limited to cases where Bitpanda suspects collusion between Participants aimed at manipulating results or any other manipulation by the Participants deemed unfair by Bitpanda.
You hereby acknowledge and accept that any breach of these Terms or any other terms and conditions of Bitpanda and/or its subsidiaries may result in disqualification.
5. Bitpanda’s liability
You hereby acknowledge and accept that Bitpanda is not responsible for the correctness of the data provided by you.
You hereby acknowledge and accept that Bitpanda will not be liable for any direct or indirect losses you might have accumulated in connection with your participation in the Raffle & Giveaway and that no right or claim against Bitpanda can arise thereof.
The winners will be selected by an internal procedure of Bitpanda and Participants will have no rights or claims against Bitpanda regarding this procedure or its results.
6. Data protection
Bitpanda collects and processes your personal data for the performance of the contract with you or in order to take steps at your request prior to entering into a contract in accordance with Article 6 Section 1 letter a of the General Data Protection Regulation 2016/679 (“GDPR”) and insofar as this is necessary for the subsequent implementation and handling of the Raffle & Giveaway.
