The following Terms (“Terms”) govern the rules for participating in the Bitpanda Birthday Promotion (“Promotion”) of Bitpanda GmbH, with its corporate seat in Campus 2, Jakov-Lind-Straße 2, A-1020 Vienna (“Bitpanda”) and the legal relationship between Bitpanda and the Participant (as defined in Section 3 or “you”) arising thereof.
By participating in the Promotion you confirm and accept these Terms and the applicable terms and conditions of Bitpanda which are an integral part of these Terms.
The term “BEST” refers to the “Bitpanda Ecosystem Token”, available for purchase on the Bitpanda platform (https://www.bitpanda.com/en/best).
This Promotion begins on the 15th of December 2020, 00:00 am (CEST) and ends on the 15th of January 2021, 11:59 pm (CEST) (“Promotion Period”).
Bitpanda will randomly select 6 Participants (as described in Section 3) (each of them referred to as “Winner” and together the “Winners”) at the end of the Promotion Period and forward each one of them 10,000 BEST (“Prize”).
You acknowledge and accept that only Participants who (i) meet all the requirements described in Section 3 and (ii) were not, for whatever reason, disqualified by Bitpanda in accordance with Section 4 are eligible to be selected as Winners.
The Prizes will be credited directly to the Winners’ respective Bitpanda Broker Wallet.
Only fully verified and registered Bitpanda clients that accept these Terms and purchase, in total, at least EUR 100.00 worth of BEST (according to the respective applicable price) during the Promotion Period are allowed to participate in the Promotion (“Participant”). For the avoidance of doubt, a Participant must trade BEST on the Bitpanda Broker to qualify for the Prize. Swaps on the Bitpanda Broker, as well as executed Savings Plans, also count towards the overall total.
You are aware and accept that Bitpanda at its sole discretion may amend and/or call off the Promotion as described herein at any time and you do not have any legal claim against Bitpanda arising out of or in connection with this Promotion.
You hereby acknowledge and accept that Bitpanda may at its sole discretion disqualify a Participant from the Promotion at any time for whatever reason, including but not limited to cases where Bitpanda suspects collusion between the Participants aimed at manipulating the results or any other manipulation by the Participants deemed unfair by Bitpanda.
You hereby acknowledge and accept that any breach of these Terms or any other Terms and Conditions of Bitpanda and/or its subsidiaries may result in disqualification.
You hereby acknowledge and accept that Bitpanda is not responsible for the correctness of the data provided by you.
You hereby acknowledge and accept that Bitpanda will not be liable for any direct or indirect losses you might have accumulated in connection with your participation in the Promotion and that no right or claim against Bitpanda can arise thereof.
The randomly-selected Winners will be selected by an internal procedure of Bitpanda and Participants will have no rights or claims against Bitpanda regarding this procedure or its results.
Bitpanda will strive to transfer the Prizes to the Winners within one week after the end of the Promotion Period. You acknowledge and accept that the price of BEST you receive will reflect the price of BEST on the day that it is sent to your Wallet and that you have no rights or claims towards Bitpanda with regard to the prices of BEST, the date the Prize is sent to your Wallet or any possible losses due to price changes connected to the transfer of Prizes. You acknowledge and agree that such transfer may be delayed and Bitpanda shall not be liable for any losses arising out of or in connection with a late transfer (e.g. losses due to price changes).
Bitpanda collects your personal data on the basis of your consent in accordance with Article 6 Section 1 letter a General Data Protection Regulation 2016/679 (“GDPR”) only insofar as this is necessary for the establishment of the legal relationship with the Participant and for the subsequent implementation and handling of the Promotion.
