“PEPE Campaign May 2025 Welcome Bonus”

1. General

The following terms and conditions (“Terms”) govern the rules for participating in the PEPE Welcome Bonus (“Welcome Bonus” or “Campaign”) held by Bitpanda GmbH, with its corporate seat in Stella-Klein-Löw Weg 17, A-1020 Vienna (“Bitpanda”) and the resulting legal relationship between Bitpanda and Bitpanda Clients participating in the Campaign (“Participant” as defined in clause 3 or “you”).

Please be advised, participating in the Welcome Bonus shall constitute your unconditional acceptance to be bound by any and all of the terms of these TC. Bitpanda terms already agreed to, in particular Bitpanda User Agreement and E-Token Terms in their current versions apply. 

Any language version is a referential translation of the original English version of these Terms. In the case of any discrepancy, the English version shall prevail.

By participating in the Welcome Bonus, you represent and warrant you meet the eligibility requirements below and acknowledge that failure to meet all eligibility requirements will result in your disqualification.

2. Duration

This Welcome Bonus starts on May 5, 2025, 00:00 (CEST) (“Start Date”) and ends on May 15, 2025, 23:59 (CEST) (“Closing Date”) (the time in between the “Campaign Period”).

3. Eligibility and Entry

Entry is open to NEWLY registered and fully verified Bitpanda Clients (“Participant”) who 

(a) meet all the requirements described in these Terms, 

(b) are one of the first 2,500 clients  who have successfully verified and registered through the provided tracking link and buy in total at least €25 worth of any crypto assets on the Bitpanda Broker during the Campaign Period (Note: Bitpanda allows only one Bitpanda Client Account per Bitpanda Client. Double accounts are forbidden.),

(c) are not resident in a country or territory where the Campaign is not available*, and

(d) accept these Terms.

The following natural or legal persons are not eligible to enter the Welcome Bonus: 

(a) persons performing market making services or any similar services as well as institutional investors,

(b) Bitpanda Technology Solution users,

(c) employees and the immediate family members of such employees of Bitpanda or its affiliated companies, parent companies, subsidiaries, participating promotional partners, advertising agencies, and any company involved in the creation, production, or fulfilment of the Campaign.

Any volume generated by the Participant prior to participating in this Welcome Bonus will not be taken into account and will not count towards purchase volume calculations. Any purchase volume generated outside of the Bitpanda Broker (e.g. transactions made via Bitpanda Fusion) will not be taken into account. Swapping assets, L-Token and Bitpanda Crypto Indices are excluded from this Welcome Bonus. 

*Please note that - due to regulatory requirements - Bitpanda Promotions are not available to users in certain restricted jurisdictions (with residence in Turkey, in the Netherlands, in Belgium and in the UK). This communication is not intended for users/countries where restrictions apply.

Please note that different rules apply for Italian residents: Participants residing in Italy are subject to special conditions. The 2,500-client limit does not apply, and the Welcome Bonus will be available for new clients during the campaign period until further notice. Bitpanda reserves the right to modify or end the Campaign at any time. 

4. Distribution of the Bonus

All qualified Participants who meet the eligibility criteria outlined in Section 3 will receive a Welcome Bonus amounting to (i) 1,000,000 PEPE Token or (ii) EUR 15 whichever value is smaller (“Bonus”). The Bonus amount is calculated based on the market value of the asset in euros (EUR) at the time it is transferred to Participants. 

Bitpanda will strive to transfer the Bonus within 30 days after the end of the Campaign Period. The transfer may be delayed and Bitpanda shall not be liable for any losses arising out of or in connection with a late transfer (e.g. losses due to price changes).

The Bonus will be credited directly to the Participants’ Bitpanda Account.

Only Bitpanda Clients who (i) meet all the requirements described in section 3 and (ii) were not, for whatever reason, disqualified by Bitpanda in accordance with section 6 are eligible to receive the Bonus.

5. Notifying Participants 

Participants will be notified via email to the email address they have stated in their Bitpanda Client Account about the payout of the Bonus. Bitpanda assumes no responsibility for undeliverable emails.

6. Disqualification 

Bitpanda reserves the right to disqualify a Participant it suspects or finds (i) to have tampered with the entry process or the operation of the Campaign, (ii) to be acting in collusion with other Participants aimed at manipulating or disrupting the Campaign, (iii) to be acting in violation of these Terms, (iv) or in breach of any other applicable terms and conditions of Bitpanda, its subsidiaries, or (v) to have provided inaccurate information.

Disqualified Participants will not be entitled to receive the Bonus.

Any attempt by a Participant to deliberately undermine the legitimate operation of this Campaign is a violation of laws, and should such an attempt be made, Bitpanda reserves the right to seek damages from any such Bitpanda Client or individual. 

Bitpanda is not responsible for the accuracy of the data you provide and may disqualify a participant if the email address of the Bitpanda Client is not valid.

7. Limitation of Liability

To the extent permitted by law, in no event shall Bitpanda be liable for any direct or indirect loss arising out of or in connection with the Welcome Bonus. 

Bitpanda reserves the right, without any prior notice or compensation to you, to suspend, cancel, postpone or modify the Campaign, at any time, for any reason whatsoever. You do not have any legal claim against Bitpanda arising out of or in connection with this Campaign.

If Bitpanda suspects that the Participant has manipulated with or abused (or attempted to manipulate) the Welcome Bonus Initiative or otherwise acted in bad faith with respect to Bitpanda, then Bitpanda reserves the right, in its sole discretion, to take the following actions with respect to such Participant and any person Bitpanda believes is acting in concert with such Participant: 

(i) temporary or permanent suspension of Bitpanda’s services (or any part thereof) and closure of the Participant's Bitpanda Account; 

(ii) Deduction/Removal of all benefits granted to such Participant (taking into account the loss sustained, which will be fully recognized); 

(iii) Deduction/Removal of all profits made by such Participant as a result of such manipulation or abuse, including the closing of all open positions in the relevant accounts at Bitpanda; and/or 

(iv) Exclusion from the Welcome Bonus Initiative and all future promotions.

Bitpanda may also exclude Participants if(i) there is a breach of these Terms, 

(ii) there is a breach of any other applicable terms and conditions of Bitpanda or its partners; or 

(iii) the data provided by the Participant is false.

Excluded Participants are not eligible to receive any bonus.

8. Privacy and Taxes

All data processing at Bitpanda is carried out on the basis of the contractual obligation in accordance with Article 6 Paragraph 1 Letter b of the General Data Protection Regulation 2016/679 (“GDPR”) for the purpose of establishing the legal relationship with the participant and for the subsequent implementation and processing of the Campaign.

Participants are solely responsible for any/all applicable taxes related to the Campaign. Participants should consult a tax advisor to determine tax implications in accepting any Bonus.
