Terms and Conditions

1. General

The following Terms (“Terms”) govern the rules for participating in the Bitpanda IOST Giveaway (“Giveaway”) of the Bitpanda GmbH, with its corporate seat in Campus 2, Jakov-Lind-Straße 2, A-1020 Vienna (“Bitpanda”) and the legal relationship between Bitpanda and the Participant (as defined in Section 3 or “you”) arising thereof.

By participating in the Giveaway you confirm and accept these Terms and the applicable terms and conditions of Bitpanda which are an integral part of these Terms.
 

2. Giveaway period and prizes

This Giveaway begins on the 18th of June, 2021, at 12:00 pm (CET) and ends on the 25th of June, 2021, at 11:59 am (CET) (“Giveaway Period”).

The TOP 1 Participant (as described in Section 3) (referred to as “Winner”) with the highest total amount of IOST purchased on the Bitpanda Platform by the end of the Giveaway Period will receive EUR 2,000.00 worth of IOST (“Prize”).

The TOP 2-5 Participants (each of them referred to as “Winner” and together the “Winners”) with the highest total amount of IOST purchased on the Bitpanda Platform by the end of the Giveaway Period will each receive EUR 1,250.00 worth of IOST (“Prize”).

The TOP 6-10 Participants (each of them also referred to as “Winner” and together the “Winners”) with the highest total amount of IOST purchased on the Bitpanda Platform by the end of the Giveaway Period will each receive EUR 800.00 worth of IOST (also referred to as “Prize”).

The TOP 11-20 Participants (each of them also referred to as “Winner” and together the “Winners”) with the highest total amount of IOST purchased on the Bitpanda Platform by the end of the Giveaway Period will each receive EUR 400.00 worth of IOST (also referred to as “Prize”).

Additionally, Bitpanda will randomly select 75 Participants who have not been selected as Winners, who are not residents of the Republic of Turkey and who are BEST VIPs (level 1 or above) and who traded any amount of IOST during the Giveaway Period (referred to as “VIP-Winners”) and award each of them EUR 200.00 worth of Bitcoin (“BTC”) (referred to as “VIP-Prize”).

Please note that the exclusion of the residents of the Republic of Turkey from being selected as VIP-Winners is based solely on the legal requirements of the Republic of Turkey.

You acknowledge and accept that only Participants who (i) meet all the requirements described in Section 3 and (ii) were not, for whatever reason, disqualified by Bitpanda in accordance with Section 4 are eligible to be selected as Winners/VIP-Winners.

You acknowledge and accept that the price of IOST for the calculation of the Prize and VIP-Prize is predetermined and will match the price for IOST on the 28th of May 2021, in the amount of EUR 0.02660376 for 1 IOST-Coin, meaning that the fluctuations in the price of IOST during the Giveaway Period will not be taken into account when calculating and paying out the Prize and VIP-Prize.

Bitpanda will strive to transfer the Prize and VIP-Prize to the Winners and VIP-Winners respectively by the 2nd of July, 2021. You acknowledge and agree that said transfer may be delayed and Bitpanda shall not be liable for any losses arising out of or in connection with a late transfer (e.g. losses due to price changes).

The Prizes and VIP-Prize will be credited directly to the Winners’ and VIP-Winners' respective Bitpanda Broker wallet.

3. Requirements for Participation

Only fully-verified and registered Bitpanda clients that accept these Terms and purchase IOST (according to the respectively-applicable price) during the Giveaway Period are allowed to participate in the Giveaway (“Participant”). For the avoidance of doubt, a Participant must trade IOST on the Bitpanda Broker to qualify for the Prize/VIP-Prize. Trades completed on Bitpanda Pro will not be counted towards participation in the Giveaway.

You are aware and accept that Bitpanda may amend and/or call off the Giveaway as described herein at its sole discretion at any time and you do not have any legal claim against Bitpanda arising out of or in connection with this Giveaway.

4. Disqualification

You hereby acknowledge and accept that Bitpanda may at its sole discretion disqualify a Participant from the Giveaway at any time for whatever reason, including but not limited to cases where Bitpanda suspects collusion between the Participants aimed at manipulating the results or any other manipulation by the Participants deemed unfair by Bitpanda.

You hereby acknowledge and accept that any breach of these Terms or any other Terms and Conditions of Bitpanda and/or its subsidiaries may result in disqualification.

5. Bitpanda’s liability

You hereby acknowledge and accept that Bitpanda is not responsible for the correctness of the data provided by you.

You hereby acknowledge and accept that Bitpanda will not be liable for any direct or indirect losses you might have accumulated in connection with your participation in the Giveaway and that no right or claim against Bitpanda can arise thereof.

The randomly selected VIP-Winners will be selected by an internal procedure of Bitpanda and Participants will have no rights or claims against Bitpanda regarding this procedure or its results.

6. Data protection

Bitpanda collects and processes your personal data for the performance of the contract with you or in order to take steps at your request prior to entering into a contract in accordance with article 6 section 1 lit. b General Data Protection Regulation 2016/679 (“GDPR”) and insofar as this is necessary for the subsequent implementation and handling of the Giveaway.
