“Bitpanda Trading Competition GOLD”

1. General

The following terms and conditions (“Terms”) govern the rules for participating in the Bitpanda Trading Competition (“Competition”) held by Bitpanda GmbH, with its corporate seat in Stella-Klein-Löw Weg 17, A-1020 Vienna (“Bitpanda”) to advertise the introduction of Bitpanda Club and the legal relationship between Bitpanda and Bitpanda Clients participating in the Competition (“Participant” as defined in section 3 or “you”) arising thereof.

Please be advised, participating in the Giveaway shall constitute your unconditional acceptance to be bound by any and all of the terms of these TC. Bitpanda Group TC and Bitpanda GmbH & BAM TC in their current versions apply.

These Terms have been written in English, any translation of these Terms shall be for convenience purposes solely and shall not have any material effect on the interpretation of these Terms. In case of any inconsistency or conflict between the English version of these Terms and any translation thereof, the English version shall prevail.

Disclaimer: Investing in digital assets carries risks. In extreme cases, the invested amount may be lost completely. Conduct your own research before concluding a transaction. Section 24 of the Bitpanda Group Terms apply. This Competition does not constitute financial advice or an invitation to conclude a transaction. You should keep yourself informed and understand the risks involved in buying and holding digital assets.

2. Competition Period 

This Competition begins on July 2nd, 2024, at 11:00 (CEST) and ends on July 8th, 2024, at 11:00 (CEST) (“Competition Period”).

3. Eligibility and Entry

Unless otherwise specified, entry is open to fully verified and registered Bitpanda Clients (“Participant”) who(a) meet all the entry criteria described in these Terms and accept these Terms, 

(b) are registered on Bitpanda Broker as French resident *(c) buys (or swaps) at least EUR 1 worth of crypto currencies within the Competition Period on Bitpanda Broker**.

(d) are Bitpanda VIP GOLD Members

The following natural or legal persons are not eligible to enter the Promotion: 

(a) persons performing market-making services or any similar services as well as institutional customers:

(b) Bitpanda Technology Solution users;

(c)employees and the immediate family members of such employees of Bitpanda or its affiliated companies, parent companies, subsidiaries, participating promotional partners, advertising agencies, and any company involved in the creation, production, or fulfilment of the Giveaway.

*Please note that - due to regulatory requirements - Bitpanda Promotions are not available to persons in certain restricted jurisdictions (eg: with residence in Turkey, in the Netherlands, in Belgium and in the UK). This communication is not intended for users/countries where restrictions apply.

**Any volume generated by the Participant prior to participating in this Competition, by opening and closing Bitpanda Leverage positions (L-Token), investing in Bitpanda CashPlus or Bitpanda Index will not be taken into account.

By participating in the Giveaway, you represent and warrant you meet the eligibility requirements below and acknowledge that failure to meet all eligibility requirements will result in your disqualification.

4. Prizes, Winner Selection and Notification

After the Competition Period has ended, 7 (seven) Participants will be selected according to the following criteria (“Winners”) and win 2x2 tickets to the announcement of our next French Ambassador, on July 14th, 2024, in Paris or 5 items of merchandise signed by the new ambassador (“Prize”).  The drawing will take place on July 8th, 2024.

• Two participants with the highest aggregated total amount worth of cryptocurrency assets purchased within the Competition Period on Bitpanda Broker will be selected. 
• Among the eligible participants (who are not winners by the above criteria), there will be a randomized selection of five additional Winners.

In the event that the winners live outside of the Ile de France region, Bitpanda will pay for transportation and accommodation to the amount of 500€ per person for one night in Paris.

Only Bitpanda Clients who (i) meet all the requirements described in section 3 and (ii) were not, for whatever reason, disqualified by Bitpanda in accordance with section 5 are eligible to be selected as Winners.

Participants, who are declared Winners in accordance with this section will be notified via email to the email address they have stated in their Bitpanda Client Account. In the event a potential Winner cannot be contacted, fails to respond or refuses the Prize, the potential Winner will be disqualified without further notice and an alternate Winner may be selected. Bitpanda assumes no responsibility for undeliverable emails.  

5. Disqualification

Bitpanda reserves the right to disqualify a Participant it suspects or finds (i) to have tampered with the entry process or the operation of the Competition, (ii) to be acting in collusion with other Participants aimed at manipulating or disrupting the Competition, (iii) to be acting in violation of these Terms, (iv) or in breach of any other applicable terms and conditions of Bitpanda, its subsidiaries, or (v) to have provided inaccurate information.

Disqualified Participants will not be entitled to become a Winner or win any other Prize under this Promotion.

Any attempt by a Participant to deliberately undermine the legitimate operation of this Promotion is a violation of laws, and should such an attempt be made, Bitpanda reserves the right to seek damages from any such Bitpanda Client or individual. 

Bitpanda is not responsible for the accuracy of the data you provide and may disqualify a participant if the email address of the Bitpanda Client is not valid.

6. Bitpanda’s liability

To the extent permitted by law, in no event shall Bitpanda be liable for any direct or indirect loss arising out of or in connection with the Competition. 

Bitpanda reserves the right, without any prior notice or compensation to you, to suspend, cancel, postpone or modify the Competition, at any time, for any reason whatsoever. You do not have any legal claim against Bitpanda arising out of or in connection with this Competition.

7. Data protection and Taxes

All data processing at Bitpanda is carried out on the basis of the contractual obligation in accordance with Article 6 Paragraph 1 Letter b of the General Data Protection Regulation 2016/679 (“GDPR”) for the purpose of establishing the legal relationship with the participant and for the subsequent implementation and processing of the Promotion.

Participants are solely responsible for any/all applicable taxes related to the Prize. Potential Winners should consult a tax advisor to determine tax implications in accepting any Prize.
