Terms & Conditions for American Bus Shuttle Giveaway 

1. General 

The following terms and conditions (“Terms”) govern the rules for participating in the Ticket Giveaway (“Giveaway”) held by Bitpanda Asset Management GmbH, with its corporate seat at Dircksenstraße 4, 10179 Berlin Germany (“Bitpanda”) and the resulting legal relationship between Bitpanda and participating Instagram users (“Participant” as defined in clause 3 or “you”). 

Please be advised, participating in the Giveaway shall constitute your unconditional acceptance to be bound by these Terms as well as those of the transportation company. 

2. Duration 

This Giveaway begins on 6th of November, 2024 and ends on 9th of November 2024, at 14:00 (CET) (“Giveaway Period”). 

3. Eligibility and Entry 

Entry is open to participants (“Participant”) who 

(a) meet all the requirements described in these terms, 

(b) scan the QR code provided to you, enter into the quiz & answer all questions correctly, 

(c)have a valid ticket to for the NFL game on November 10th 2024 (If you don’t have a valid ticket, you still have the chance to win one signed football), 

(d) have reached the minimum participation age of 18 years, 

(e) accept these Terms. 

Each person may only take part in the Giveaway once. Multiple entries are not permitted. Bitpanda reserves the right to exclude Participants from the Giveaway in the event of multiple entries. 

Employees and the immediate family members of such employees of Bitpanda or its affiliated companies, parent companies, subsidiaries, participating promotional partners, advertising agencies, and any company involved in the creation, production, or fulfilment of the Promotion are also not eligible. 

4. Prize Drawings, Notifying winners and Distribution of the Prize After the Giveaway Period has ended, Bitpanda will according to the criteria set out below:

● randomly choose 12 Participants (“Winner”) that will each receive 2 (two) spots for the transportation on an American school bus to the NFL game between the Dolphins and Chiefs on November 10th in Munich, (“Prize”). 

● randomly choose 1 Participant that doesn’t have a valid ticket, that will receive a signed football. 

Only Participants who (i) meet all the requirements described in section 3 and (ii) were not, for whatever reason, disqualified by Bitpanda in accordance with section 5 are eligible to be selected as Winners. 

Participants, who are declared Winners in accordance with this section will be notified via the contact details provided. The winners must respond to this before 6 pm on Saturday 9th, 2024 to claim their prize. In the event a potential Winner cannot be contacted, fails to respond or refuses the Prize, the potential Winner will be disqualified without further notice and an alternative Winner may be selected. Bitpanda assumes no responsibility for undeliverable emails. Potential winners may be subject to verification by Bitpanda. The shuttle will depart from a designated pick-up location in Munich city centre and will drop off the Winners (and their +1) at the Allianz Arena before the game. 

The awarded prize cannot be redeemed for cash or resold. 

5. Disqualification 

Bitpanda may disqualify a Participant it suspects or finds (i) to have tampered with the entry process or the operation of the Giveaway, (ii) to be acting in collusion with other Participants aimed at manipulating the Giveaway, (iii) to be acting in violation of these Terms or engaging in reckless behaviour that pose a risk to other passengers, (iv) to have provided inaccurate information. In addition, the bus driver or security personnel may ask Participants exhibiting the following behaviours to leave the bus: disruptive noise level, intoxication, aggression and threatening behaviour, possession of prohibited items, vandalism or damage to the bus, or otherwise ignoring safety instructions. 

Disqualified Participants will not be entitled to become a Winner or to continue with the bus ride or receive another prize within this Giveaway. 

6. Limitation of Liability 

To the extent permitted by law, in no event shall Bitpanda be liable for any direct or indirect loss arising out of or in connection with the Giveaway. 

In the event that the Winner fails to catch the bus, for whatever reason, Bitpanda accepts no liability. We therefore advise the Winners to arrive on time at the departure point. 

Participants understand that there are inherent risks associated with travelling on buses. The bus transport is organised by a third party transportation company.The transportation company shall bear sole responsibility and liability for any and all aspects of the bus ride, including delays, cancellations, and other operational matters. Bitpanda disclaims all liability for any claims, damages, or incidents arising during or as a result of the bus ride, as these fall exclusively under the responsibility of the transportation provider. 

Bitpanda reserves the right, without any prior notice or compensation to you, to suspend, cancel, postpone or modify the Giveaway, at any time, for any reason whatsoever. You do

not have any legal claim against Bitpanda arising out of or in connection with this Giveaway. 

7. Privacy and Taxes 

The processing of personal data is carried out in accordance with Article 6 Paragraph 1 Letter b of the General Data Protection Regulation 2016/679 (“GDPR”) for the purpose of establishing the legal relationship with the participant and for the subsequent implementation and processing of the Giveaway.

Winners are solely responsible for any/all applicable taxes related to the Prize. Potential Winner should consult a tax advisor to determine tax implications in accepting any Prize. 

8.Miscellaneous & Contact 

Bitpanda reserves the right to amend the conditions of participation at any time. Should individual provisions of these conditions of participation be or become invalid, this shall not affect the validity of the remaining provisions of these conditions of participation. Cash payment of the prize is not possible. Legal recourse is excluded. 

The Giveaway is in no way connected to Instagram and is in no way sponsored, supported or organised by Instagram. The recipient of the information provided by the participants is not Instagram, but Bitpanda as the organiser.
